I am experiencing the exact same issue, unfortunately I have not found a solution yet.
ITECIR device is missing from device manager whenever I wake the machine from sleep. Reboot of the system is needed for remote control to function properly again within windows (it will still wake the machine if I put it to sleep again). Remote control (Logitech Harmony) works perfectly with the system except for this one issue.
Like you, I have updated to Windows 10 with free upgrade so I don't want to exchange the box. However since the CIR still works outside of windows environment when the device is a sleep, I would assume this is a driver issue.

This would indeed be a bug in the CIR driver. I have sent a note regarding this issue to the support folks at Intel.
I am with Intel Customer Support and just so you know the issue that you guys reported is being investigated by Intel engineering as we speak and it seems to be a software issue and not a hardware problem. I would recommend not to return the Intel® NUC Kit NUC5PPYH that you have and allow us some additional time to come back with a resolution for this situation.
