Updated the BIOS to 0042-no help! Did a third and fourth clean install with the Intel Windows 7 USB3 Creator Utility-no help!

The bios update to 0042 fixed the network disconnected issue but you may want to remember this helpful tip when answering questions that relate to the USB3 issues-make sure you are using a PC that will allow the DISM to run correctly!
I found out it was my corporate laptop that caused the issue on using the USB3 creator-once I moved to a different PC and used the creator, it work without any issues.
So to answer your questions-the NUC is working fine and thanks for all the help.
